Silence counterspell?

FWIW: I've seen silence used in play....I've been the one to use it!

When playing WotC modules, preparing the spell was a no-brainer. I've aced the BBEG in 3 separate adventurers this way.

(EDIT: Durn typo!)

By the raw you get no spell resistance, and by the way it is written it definately seems like that was the designers intent as well. It effects the 'area' not the creature that happens to be in the area.

You can talk just fine, but once the sound leaves wherever the sound is made from the silence kills the sound. It doesnt do anything to the creature at all.
In that case, the question is "Does the verbal component have to leave your person for the spell to work, or is it enough that you said it?" With the side-question of at what point the air leaving your mouth becomes "unattended." :)

Which is, of course, where my houserule comes in. But, in normal d&d, you have to speak them in a loud, clear voice. Just like you cant cast the spells underwater without being able to speak, or through a gag. Although being able to cast through a gag would be interesting it would just make captured mages that more difficult and killed as soon as possible ;) you can after all stop a fighter from attacking by taking away his weapons and tieing up his hands, there should be some reflection of that in other classes as well.

Edit: and they all do, while being tied up ;)
