No, It is caster level unless the spell is cast more than a minute befor the fight. Using a flame reduces the duration by a minute. if you have 30 seconds left, you still can throw the flame for the full 1d6+level.
Further, the fact remains that these things are expendable, whereas the Brilliant Energy is only an issue if your DM is Disjunctioning or Sundering.
How many fights are the players actually going to wind up in? Unless notably slow advancement is used {reduced XP and treasure], charged items last a long time. Unless the DM throws wave after wave of classed NPCs in magic armor, the wands will be far more useful. And if he does, a cheap "Staff of fire" is great for a rogue to mop the mooks with.

Lets say a rogue does 3 points of damage but the monster he is fighting has damage reduction of 5. If sneak attack was the was insuperable from the initial damage, the sneak attack would apply and help to do damage from the creature..

However it doesn't. The damage is separate from its source (however symbiotic it may be)

Ummm... do you have a source for this? I've always assumed (and ruled) that sneak attack does help overcome DR.

Yes, it does.

A rogue who rolls a 3 on his shortsword damage and 13 on his sneak attack dice would deal a total of 11 points of damage to that monster: 16 - 5.
