BOZ: Illithid-kin in d20?

I was informed by WotC's legal department that references to, basically, anything published in "The Illithiad" or Illithid-centric Dragon magazine articles, as well as use of the term "Illithid" or any terms from those articals not reprinted in the SRD, was NOT A GOOD THING!

In no uncertain terms, doing so is NOT allowed under the OGL.

So how did you guys pull it off?

I've seen nothing illithid-related in printed form (i.e., in the ToH). The conversions of master brains and co. are only in web-page form.

So this gets around the OGL ban on non-SRD material?

Basically they are conversions, done under the conversion agreement found on http://www.wizards.com/d20 (http://www.wizards.com/d20/files/ESDpolicy.rtf).

Basically you can do it, if you a) state where you got the original from, b) include lots of stuff to do with wizards copyright and c) don't try and sell it - it covers fan-based conversions only.

Scott and those at the Creature Catalog seemingly have a very good relationship with Wizards and have checked it all out with them so if I've got any of this wrong then don't sue me.

so far as i've heard, WotC has not only not complained about the creature catalog (outside of making sure the content theirin is not using copywritten material, and that was cleared up some time ago), in fact they've all but praised it, IIRC. if someone official complains about my conversions, i will modify them or take them down.
