This is exactly my point, if there is no save he will use it most definitely (1st level spell, very low cost at high level). Imagine you are fighting a powerful NPC (human, no resistance) and he becomes moderately wounded, as a first level slot you could take him down (no save) and using a higher level slot (easy). Or else you need to always have you NPC'S have some sort of resistance or else, bye bye

What about a 1st level magic missile that can't miss to take down a mortally wounded NPC? Or easily bump it up to a higher slot for even more damage that can't be resisted.

Also, how would the rogue fail their checks? A rogue with expertise will have at least a +7 to Stealth at level 1. Most characters will have, at most, a sleeping passive perception of 9. The rogue succeeds on a roll of 3 or higher.

Yes but killing your companion beside you might wake others up but not from magical sleep...
