On page 25 there is a sidebar (er, "bottom bar"?) entitled "monsters as epic characters." It explains the situation and gives an example. A character with 16 class levels and a +5 level modifier is ECL 21 and is eligible for a feat, provided prerequisites are met.

Of course, the character doesn't get a feat at that level, BID

So to sum up and add on a little bit, according to ELH page 25, with regards to everything in the book except for BAB and Base Saves, always use ECL rather than just level. and on page 46, it says that starting at 21st level (or ECL 21, if following the sidebar from page 25), one can qualify for epic feats. it further states on page 46, under Prerequisites, that "A character can gain an epic feat at the same level at which he or she gains the prerequisite, just as with regular feats."
If one were to take that last quote on its own, without referencing the rest, it might be reasoned that a person can even take epic feats at nonepic levels, and given the steep prerequisites, I _might_ personally allow it in my games (I haven't decided yet), since at least for most PCs, those requirements are not likely to be met until very high or more likely epic levels.
 

thank you. that bout sums it up for me. i guess i should start reading the sidebars and footnotes instead of skimming them.

but as a note to striderman, U might want to read all the feats before letting characters take them b4 epic levels...some of the prereq's are not that steep, Damage Reduction can be gained by a lucky dwarf at 4th level and Dire Rage could be taken by a fighter at 2nd or a human fighter at 1st (granted they wouldn't get the benefit that early, but they could take it).
 

They kind of infer that you have to be epic level(21+) to take epic feats. Once you are "epic" you can take an epic feat any time you have are eligible for a feat.

Now, wether or not some of the "Epic" feats should really be "epic" is another thread...

They don't just imply it, they outright say it in the book, as a couple of us noted above with page references (page 46). One particular line that I have read (also on page 46) implies that they can be taken before epic levels are achieved, but when faced with the places where it outright says so, it is obvious that according to a strict rules interpretation, one has to be of epic level to take epic feats.
 

As I understand it, your level 20 fighter feat can not be an epic one because you are not an epic fighter yet and therefore do not have the epic bonus feat list. However, if, say, you were an ECL +3 race, then your level 18 general feat could be epic because you are an epic character in total (ECL 21).
