Oath of Emnity is not a condition.

You need at least being strong enough to carry your scalemail and two-handed weapon or weapon/ shield combo. And hopefully strong enough to carry some treasure

Always hated the halfling paladins jogging around in plate armor and a heavy shield with Str 8...

Human Paladin (or battlemind) has plate armor weighing fifty pounds, a heavy shield weighing 15 and a weapon weighing up to 10 lbs. That doesn't reach his normal load even with a Strength of 8 (=80 lbs). It doesn't leave much room for rope and ten foot poles, though. Two handed weapons will weigh less than a shield plus weapon (and halflings are restricted to even lighter weapons).

Marked always has been a condition (see pg. 277 of the PHB).

The Staff of Aversion states:
"You gain a +2 bonus to all defenses against attacks from enemies that are subject to effects caused by you."

It doesn't specify conditions as such.

Ah my bad, it's subject to effects caused by you as the description of the staff. Is there a specific definition of what an effect is somewhere? If it's something by an effect line, that would include OoE and powers that mark specifically at least right?

An effect is anything a power does.

So, yes, OoE does trigger it.
