One question. Why? Why would you want to have a weapon with this property?

Well, for the price of a +1 bonus, you get 2d6 extra damage to your enemies. And you need no defense from a dead opponent.

I had a character with a Vicious weapon from about 5th level until the campaign ended, at 12th. I loved it. The character was sort of a pinwheel of death, dealing a pretty insane amount of damage, and taking quite a bit himself. He was a psychic warrior, and relied on his Vigor power to offset the Vicious weapon damage. Quite a bit of the time, he had a Shield Other spell from the party healer, which also helped. The GM decided that, once I picked up the Vampiric Blade power, I could handwave away the Vicious damage, since I was regaining 1d6 hitpoints and taking 1d6 from the weapon with each hit. Didn't seem to use that very much, though.

Shockingly enough, I don't think that character ever died. He got beaten up quite a bit, though.

Makes a real nice property for the off hand weapon.

All power attack, all the time
always wants more damage. They hit less often anyhow, but when they hit...

You have a cleric focused on healing in the party

Vicious armor spikes can come in real handy for ending grapples, You need the damage to cut your way out of some things.

Anything with regeneration or fast healing makes vicious easier to use.

Your DM never uses weak mooks who would die in one hit without the vicious damage.

You hate your bane weapon's main foe more than you like living.

Sword and boarders who want their one handed weapon to deal at least some damage.

Gnome or dwarf barbarians.

Now, if you use whirlwind, great cleave, combat reflexes, are an elf or have a LA, you might not want this properrty.

Hmm, seems a natural fit for a Frenzied Berserker in a Deathless Frenzy.
Beat me to it, wolfpunk. Our party's Frenzied Berserker had this on his greatclub. Ugly, ugly, ugly ... I think I'd actually recommend to DMs working out which expansion elements to include in their game, to pick one of these to ban. (And I can easily guess which they'd choose. :) )

Just as a side note- I'm designing a PC inspired by this thread.

He's a Paladin/Kensai. He'll be wielding Pax Malleus, a Maul that will be (among other things) Oversized, Holy, Vicious...and Merciful- at this point doing 2d8 x3B +2d6Holy + 2d6Vicious + 1d6Merciful.

Since its Merciful, all damage it does is non-lethal while the Merciful enchantment is active, so it can quickly and efficiently render someone unconsious. Of course, there will come a time when he'll have to turn off that enchantment.

Lol me too! Of course I'll have to give him a different name. :P
