No policy was actually changed. It's like someone talking about robbing a bank, casing the joint, drawing up plans and then deciding they couldn't get away with it after getting a better understanding of the security.

No matter how often you repeat it, they made no policy changes. I don't trust them any less now because I never trusted them in the first place. Either I will spend money on their products because they offer something I want or I won't.
No, policy was changed. They put the SRD 5.1 into CC. That's an historic event and a huge deal. And they did it because they acknowleded they messed up.

This is a bad example as it's against the law to plan a crime

It has never, to my knowledge, been 100% confirmed what was precisely sent out. I have several threads on this and the only person to say they had eyes the actual term sheets (the one with signature lines) said there was specific language that it could be negotiated. I'm not saying your wrong, but I am only comfortable with saying we don't know. Everything else is speculation IMO.
They negotiated with, and signed an agreement with Kickstarter.
Actually we don't know that precisely either do we. I have never heard that there was a signed document. Kickstarter asked for better rates, and they were under the impression they would get them, but as far as I know it never got to an actual signed document.

FYI, here is what John Ritter said:
"Kickstarter was contacted after WoTC decided to make OGL changes, so we felt the best move was to advocate for creators, which we did. Managed to get lower % plus more being discussed. No hidden benefits / no financial kickbacks for KS. This is their license, not ours, obviously."

That doesn't sound like a signed contract to me. YMMV.

If you want to be pedantically correct, planning is not a crime is not a criminal act unless you involve others in your plan at which point it can be considered conspiracy.

The point is that the bank was not robbed.
No. But the robbers handed the teller the note! And only after the teller warned others in the branch did they decide not to rob the bank.

And ... this analogy has been stretched to the breaking point.

No policy was implemented, corporations (and people) think about and plan on doing stupid things all the time. I don't see the point of continuing to be upset about something that could have happened.
