Go with the intention of the rule instead of trying to purposely misinterpret a certain bit of text for your own benefit.

Well, that's making a whole lot of assumptions.

I'm not playing any high-level clerics, I'm DMing 5th-6th level characters right now, and I'm not planning on converting any of my own games to 3.5.

I'm not trying to "purposely misinterpret" anything - I'm trying to see how the spell has changed in 3.5. By what I see, it looks to me as though they've added a save, added a damage cap, and allowed the spell to kill on a failed save.

Well, I hope Andy clarifies it. I still feel it wasn't intended to kill even on a failed save. The wording is just a bit off. I do alot of writing, and it is hard to catch every possible ambiguous sentence. I'm still going with the orginal flavor of Harm where it reduces you to near death, but cannot kill you until I hear otherwise.
 


As it is written there is absolutely doubt that Harm can kill on a failed save, but I seriously doubt that they intended it that way. I'm goint to Rule 0 it IMC until the first errata is out.

I'm seriously disappointed with the amount of errata in 3.5, IMO it actually worse than 3.0 which is pretty disappointing for an update that was supposed to be at least partially about getting it right this time.

If they wanted to make it a blanket condition of Harm, it should go in its own sentence - if not its own paragraph! - not in a clause tacked onto the end of a sentence that begins with a conditional!

I now realize that the whole story about how Sammaster started the Cult of the Dragon is not as hokey as it sounds! :)
