It would be smart as part of a package of excerpts. As the only currently available excerpt (and asking people to go back through the increasingly useless Previews for a nugget isn't realistic), it's inane.
Actually, Desert Wind is an excerpt in the most recent (June '05) previews. So it's not buried as far down as you imply. In fact, the previews link takes right to the current page, so no digging through the archives necessary.

You know, they did make a bit of an error in choosing a mindflayer. By placing it in electronic media where any can see it - and readily save it, I mean. Doesn't that weaken their statement that Mindflayers are not part of the open game license somehow? Probably not. Just a random thought that occurred to me.

In any cast, I expect if someone where to reverse engineer the posted flayer vs the one found in the 3.5 MM we would have the details for a template called 'monster of legacy'.

I wonder if there are also classes of legacy? After all, they did have class substitution levels in the planar handbook. A class of legacy that adds a few extra (albeit minor) features here and there without removing anything might be viable. Perhaps a cleric of legacy might gain access to a third domain, and perhaps gain bonus feats at 8 and 16 for use in divine or turning feats only. Perhaps a fighter of legacy - should they choose weapon focus / spec / etc have those apply to all weapons used. Perhaps a ranger of legacy gains an additional combat mastery at a higher level (16 to 18), treats his animal companion as a druid of 3/4 level rather than 1/2, and gains a one or two additional areas to apply the bonus gained from favored enemy?

Well, who knows. I guess we'll find out. (I still think there is something intrinsically wrong with how weapons of legacy work, however. See my posts on the thread dealing with Desert Flame, the example weapon.)

I haven't gone over the Mindflayer of Legacy stats with a fine tooth comb, but this is what jumps out as different at a casual glance:

Deflection: Shuluth enjoys an inherent +1 deflection bonus to its AC.

Mirror Image (Sp): Once per day by uttering a vile command word, Shuluth can use mirror image as the spell. Caster level 5th.

Omen: All creatures within 15 feet of Shuluth that have a language "hear" dire mental whispers forecasting their sudden and painful demise. Shuluth can suppress or emit this telepathic aura as a free action.

See Invisibility (Sp): Once per day by uttering a vile command word, Shuluth can use see invisibility as the spell. Caster level 5th.

This suggests that a monster of legacy gains Deflection +1, omen, and two spell like abilities useable once per day and - presumably - chosen by the PC (or DM, if an NPC creature). There might be some other enhancements - to save DCs of other abilities, to stats, to skills, etc. I just don't have the means to check at the moment.

What's with the crappy excerpt posted on the WotC site for Weapons of Legacy? Seeing the link, I was looking forward to more info on this potentially interesting supplement. Instead, we get a stat block for a mind flayer with a couple of extra spell-like abilities, which tells us almost nothing about the book. It sort of reminds me of movie studios that don't release a movie to critics ahead of the street date when they know the film is bad -- so the critics can't write any bad reviews before the movie is released to the public. I hope this isn't the case with Weapons of Legacy....
Yeah that was horrible. I was hoping for a tidbit as I"ve been expecting this book and I was shocked to see a mindflayer up there.

Not at all, it's still their copyright, and they don't have to release anything OGL they don't want to, and being honest, it was quite generous of WotC to even agree to the OGL. Just because it is on the web doesn't mean it's free of copyright entanglements, it just means you are able to hit the "save" button on your browser and save a copy.

All this does is put an easy electronic copy of it online for people to save, for people who use the SRD's as quick and free electronic references (instead of a publisher's guide to the d20 System), and if you've got a moment, you can excise the template and have letter-perfect illithid stats a lot quicker than hand typing it.

That's fantastic. It still shouldn't be necessary to look somewhere else than the marked excerpt to find an excerpt that's actually typical of the content in the book.
