Dismissal without prejudice means that the suit can be filed again. The suit lasted two days from the 7th to the 9th of December. The IndieGoGo fundraiser to fund it is still running.



At first glance, the below document is dated 21st October so it’s reasonable to assume that it is not related to the recent filing; however, apparently that date is incorrect. The correct date is in the footer, and this is indeed the dismissal of the recent filing and can be found on PACER (Public Access to Court Electronic Records).

They're less convincing than this scam letter I once received when I lived in North Hollywood, California. The letter told me that I had won the Mexican lottery, which I've never entered. I don't remember how many pesos it was, but in parentheses it had 300ish million USD. All I had to do to claim my winnings was send $20 to an address in Amsterdam. 🤦‍♂️
I got one that simply said in broken English, “You won lottery. Send money.”

No amount given. No address given. To fall for it, you’d have to respond to their email to ask them for more info.

And I get IRS scammers calling using a robotic voice delivering threats in broken English. (If I’m ever jailed by the Feds, it will be because I hung up on Agent PunjabiTron.)

Yes. The lawsuit was re-filed in an appropriate venue (federal court, Washington state). As of Jan. 27, 2022 (which is the most recent update in the threads I am aware of), the parties agreed to stay the pending administrative proceedings until resolution of the federal case, and WoTC had not responded yet to the filing.

The actual complaint did not differ substantively from the one originally filed, which leads me to continue to believe that TSR has an incredibly low likelihood of success, and may be subject to sanctions. I would note that since the whole issue with Darlene popped up, it would appear that they have gone to just using the Lizardman logo- but that also has issues, given that they seem to be using the wrong Lizardman logo (fun fact- there were two, created by different artists, used at different times). I can't tell for sure, since TSR doesn't use original art, and the scan is bad enough that I have trouble differentiating them.

If someone has checked that docket recently, please feel free to update.

I'm guessing that's stuff that they already made*. It seems that the stuff that they are claiming that they have made recently (but, you know, haven't actually made) just has the Lizardman logo.

Because reasons, I guess? Who knows ... I'm long past trying to ascribe intelligent motives to these people.

They also use the wizards logo on their website. Right up top, front and center lol.

Nothing new (as of this morning) on the lawsuit docket. Latest docket entry was on 1/06/22 with notices going out to both the patent and copyright offices.
