Okay, this came up in a game not to long ago. There is a 1/10 Ranger/Barbarian in my party as well as a 11 Rogue. They went into a Thives guild to access it's portal. They fought lots of rogues of whom were 9th level. Now, what is the ruling on sneak attacks for these two, do the 9th level rogues not get thier sneak attack ever against them, or only in certain situations. Is there ever a time when someone no matter what can't be sneak attacked? When does this come up. The rules told me that it can happen when someone loses thier Dex, or is flanked, but if you never can be flanked, or what not, does that negate the sneak attack. You don't get the +2 for it, but you should technically still be flanking...

They keep their dex bonus to AC unless they are immobilized and they cannot be flanked except by a rogue of 4 or more levels higher than them. Your 9th level rogues will be unable to sneak attack them unless, of course, they are immobilized.
 

Both the barbarian and the rogue cannot be flanked unless the attacker is 4 levels above them. It's not just that the attackers are denied their +2 attack bonus, they're not technically flanking (since the Brb and the Rog can react to enemies on opposing sides as easily as they can react to a single enemy. So these Rog9ers won't be able to sneak attack them, unless they can mobilize the two (since that will make them lose their dex bonus, and AFAIKeven give them an effective Dex of 0 and a Dex Mod of -5). You'll need a Rog14 for the Brb and a Rog15 for the Rog.
 

What about surprise round, am I to assume that Rogues and Barbarians are never surprised? "Yeah, knew you'd be here, you silly phase spider." What?

They can be surprised, but no matter what they'll keep their Dex bonus to AC. Uncanny, huh? ;)

They can be surprised, they just don't lose their dex bonus.
 

Just remember that Uncanny Dodge only protects against losing your Dex bonus when flat-footed or when facing invisible opponents. It's pretty specific.

It will not allow you to keep your Dex bonus when you have been Bluff/Feinted, when you are Running, when you are Climbing, when you are Stunned, when you are Cowering in fear, when you are grappled, etc.
